Clearwater Police Charge Man With DUI, Child Neglect For Having Son In Car While Intoxicated

A Largo man has been charged with driving under the influence and child neglect after police found him intoxicated behind the wheel with his 4-year-old son in the back seat.

David Timothy Higgins, 26, pulled into a Wendy's at 900 S. Missouri Ave. about 10:30 p.m. Sunday - shortly after the Super Bowl had ended - to order food.

The manager there at the restaurant noticed he was intoxicated and had a child in the back seat. She asked him to pull his car over while she waited on his food to cook; instead she called Clearwater Police.

Officers responding to the scene noticed a strong odor of alcohol coming from Higgins. His eyes were bloodshot, his speech was slurred and he failed several sobriety tests.

He told officers he had been watching the Super Bowl and had consumed five beers. When asked why he was driving with a child in the car, he said he didn't think he was that intoxicated.

Higgins was taken to the Pinellas County Jail and booked on the two charges.

It is not his first DUI. He also was arrested on a similar charge by St.

Petersburg police in June 2012.
